1. Agreement to Terms

Welcome to InsureDirect LLC ("InsureDirect," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, online quote tools, and related services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.

InsureDirect LLC is a licensed insurance agency operating in North Carolina and other states where properly licensed. We are not an insurance carrier. We represent multiple insurance carriers and receive compensation from carriers for policies written.

2. Website Purpose and Informational Nature

Our website is designed to provide general insurance information and facilitate the insurance quote and application process. The information provided on our website is for informational purposes only and does not constitute:

• A binding insurance contract or policy
• A guarantee of coverage or specific rates

All insurance coverage is subject to underwriting approval by the insurance carrier. Quotes provided through our Services are estimates only and may change based on additional information, carrier underwriting guidelines, and other factors.

3. No Guarantee of Specific Rates or Coverage

Quotes Are Estimates Only: All quotes provided through our online quote tools or by our licensed agents are estimates based on the information you provide. These estimates are not binding and do not guarantee:

• That you will qualify for coverage
• The final premium amount
• Specific coverage terms or limits
• That you will receive the lowest available rate

Final rates and coverage terms are determined by the insurance carrier during the underwriting process. Rates may be higher or lower than quoted based on factors including but not limited to: credit history, driving record, claims history, property characteristics, and carrier-specific underwriting criteria.

No Coverage Until Confirmed: Insurance coverage is not bound or in effect until you receive written confirmation from the insurance carrier or InsureDirect LLC. Submitting a quote request or application does not create coverage.

4. User Eligibility and Requirements

To use our Services, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding contract
• Reside in a state where InsureDirect LLC is licensed to sell insurance
• Provide accurate, complete, and current information
• Comply with all applicable laws and regulations

Accurate Information Requirement: You agree to provide truthful, accurate, and complete information when requesting quotes or applying for insurance. Providing false or misleading information may result in denial of coverage, cancellation of a policy, or denial of claims. Insurance fraud is a crime and may be prosecuted.

5. Prohibited Uses

You agree not to use our Services to:

• Violate any federal, state, or local laws or regulations
• Provide false, inaccurate, or misleading information
• Impersonate any person or entity
• Engage in fraudulent activity or insurance fraud

TO THE FULLEST EXTENT PERMITTED BY LAW, INSUREDIRECT LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Errors or omissions in content or information provided
• Interruption or cessation of Services
• Unauthorized access to or alteration of your transmissions or data
• Actions or omissions of third-party insurance carriers
• Denial of coverage or claims by insurance carriers
• Differences between quoted and actual premium amounts

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT OF COMMISSIONS WE RECEIVED FROM YOUR INSURANCE POLICY, OR $500, WHICHEVER IS LESS.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

8. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of accuracy, reliability, or completeness of information
• Warranties that the Services will be uninterrupted, secure, or error-free

You agree to indemnify, defend, and hold harmless InsureDirect LLC, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your violation of any rights of another party
• Your provision of false or misleading information
• Your violation of any applicable laws or regulations

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles.

Any legal action or proceeding arising out of or relating to these Terms or our Services shall be brought exclusively in the state or federal courts located in Mecklenburg County, North Carolina, and you consent to the personal jurisdiction of such courts.

12. Dispute Resolution and Arbitration

Informal Resolution: Before filing a claim, you agree to contact us at support@insuredirectonline.com to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith.

Binding Arbitration: If we cannot resolve a dispute informally, any controversy or claim arising out of or relating to these Terms or our Services shall be settled by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association.

Arbitration shall take place in Charlotte, North Carolina. The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.

Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between you and InsureDirect LLC individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on our website with a new "Last Updated" date
• Sending an email notification to registered users (if applicable)

Your continued use of our Services after changes are posted constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using our Services.

14. Termination
