These Terms of Service contain important provisions including a binding arbitration clause (Section 18), a class action waiver (Section 19), and limitations on our liability (Section 16). By using AssureArc Services, you agree to be bound by these terms.
1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and InsureDirect LLC d/b/a AssureArc ("AssureArc," "InsureDirect LLC," "we," "our," or "us"), governing your access to and use of InsureDirectOnline.com and all related applications, tools, quote engines, client portals, and services (collectively, "Services").
By accessing our Services — including by clicking "Get a Quote," submitting any form, creating an account, or continuing to use any page of our website — you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not use our Services. We reserve the right to update these Terms at any time as described in Section 22.
2. About AssureArc — Agency Disclosure
AssureArc is the consumer brand and doing-business-as (d/b/a) name of InsureDirect LLC, the licensed insurance agency entity. InsureDirectOnline.com is the online presence of AssureArc. All insurance services are performed by InsureDirect LLC in its capacity as a licensed independent insurance agency.
We are an independent insurance agency. We are NOT an insurance carrier. We do not underwrite insurance policies, assume insurance risk, or pay insurance claims. When you purchase a policy through AssureArc, your insurance contract is between you and the issuing insurance carrier. AssureArc's role is to help you identify, compare, and obtain appropriate insurance coverage.

3. Description of Services
AssureArc provides the following services through our website and licensed agents:
- Online and agent-assisted insurance quote comparison tools
- Insurance application submission and carrier placement assistance
- Policy servicing, endorsements, cancellations, and reinstatements
- Claims reporting assistance and carrier liaison services
- Certificate of Insurance (COI) requests for commercial clients
- Insurance education content and resources
- Annual policy review services
- Client portal for policy management and document access
- Dealer Finance & Insurance (F&I) products for dealership partners
Our Services are available to residents of states in which InsureDirect LLC holds a valid insurance agency license. We do not offer insurance in states where we are not licensed.
Informational Content: Educational articles, guides, coverage explanations, and other informational content on our website are provided for general informational purposes only. This content does not constitute legal, financial, tax, or professional insurance advice, and should not be relied upon as such.
4. No Guarantee of Rates, Coverage, or Outcomes
4a. Quotes Are Estimates
All premium quotes generated through our online tools or communicated by our agents are estimates based solely on the information you provide at the time of inquiry. Quoted premiums are NOT binding, do NOT constitute an offer to insure, and are NOT a guarantee of:
- Eligibility for coverage with any carrier
- The final premium amount
- Specific policy terms, conditions, exclusions, or limits
- The availability of a specific product in your area
- The lowest available rate in the market
4b. Carrier Underwriting Authority
Final rates and coverage terms are determined exclusively by the insurance carrier during their underwriting process, based on factors including but not limited to: credit-based insurance score (where permitted), claims history, loss history reports, motor vehicle records, property inspection results, and carrier-specific underwriting guidelines. InsureDirect LLC has no authority to override carrier underwriting decisions.
4c. No Coverage Until Confirmed
Insurance coverage does not take effect until: (1) you receive a written policy binder or confirmation of coverage from the insurance carrier or AssureArc, AND (2) required down payment has been received. Submitting a quote request, completing a quote form, or speaking with an agent does not create insurance coverage.
5. User Eligibility
To use our Services, you represent and warrant that you:
- Are at least 18 years of age and possess the legal capacity to enter into a binding contract
- Are a legal resident or citizen of the United States
- Reside in a state where InsureDirect LLC is currently licensed
- Are not currently suspended or prohibited from receiving insurance-related services
- Are not submitting applications on behalf of another person without proper legal authority
- Will comply with all applicable federal, state, and local laws in connection with your use of our Services
6. Accurate Information — Your Obligation
You agree to provide truthful, accurate, complete, and current information in all interactions with AssureArc and its agents, including when completing quote forms, insurance applications, and policy change requests.
Material Misrepresentation: Providing false, misleading, or materially incomplete information in connection with an insurance application may constitute insurance fraud under state law and may result in: voiding of any policy issued; denial of a claim; rescission of coverage from inception; civil and/or criminal liability.
Duty to Update: You have a continuing duty to notify us of material changes to information relevant to your coverage (e.g., new drivers, change of address, acquisition of additional property or vehicles) within 30 days of such change.
7. Agent Compensation Disclosure
North Carolina law and sound consumer protection principles require insurance agencies to disclose how they are compensated. In accordance with NC Gen. Stat. § 58-33-10 et seq. and applicable DOI regulations:
- InsureDirect LLC receives commissions from insurance carriers for policies placed through our agency. Commissions are a percentage of the premium paid by you to the carrier and are built into the carrier's standard rate structure.
- In certain commercial insurance transactions, InsureDirect LLC may also charge a service or advisory fee, which will be disclosed to you separately in writing prior to binding coverage.
- Commission rates vary by carrier and product line. AssureArc does not guarantee that it has placed your coverage with the carrier offering the highest commission; carrier selection is based on suitability for your needs.
- InsureDirect LLC may participate in contingent commission arrangements with certain carriers based on premium volume and/or loss ratios. These arrangements do not influence individual placement decisions.

8. Electronic Signatures & Communications (E-SIGN Act)
By using our Services, you consent to receive legally required notices, disclosures, policy documents, applications, and other communications in electronic form pursuant to the Electronic Signatures in Global and National Commerce Act (E-SIGN Act), 15 U.S.C. § 7001 et seq., and applicable state electronic signature laws.
Electronic signatures are legally binding. When you electronically sign any document through our platform, that signature has the same legal effect as a handwritten signature.
System Requirements: Internet access; current web browser (Chrome, Firefox, Safari, or Edge); valid email address; ability to view PDF documents.
Withdrawing Consent: You may withdraw E-SIGN consent by contacting us in writing. Withdrawal is prospective only and does not invalidate prior electronic signatures or disclosures. After withdrawal, we may be required to provide paper communications, and certain Services may no longer be available electronically.
9. TCPA Consent for Communications
By providing your phone number and submitting a quote request or contact form on our website, you expressly consent (in accordance with the TCPA, 47 U.S.C. § 227) to receive:
- Telephone calls from licensed AssureArc agents regarding your quote, application, or policy
- Automated or pre-recorded calls for service-related matters with your prior express consent
- SMS/text messages regarding quotes, coverage, renewals, and account updates
Marketing Communications: You separately consent to receive marketing calls and texts by affirmatively checking the applicable opt-in box on our quote form. This consent is not a condition of purchasing insurance.
Do Not Call: If you are on the National Do Not Call Registry and have not provided express written consent, we will not call you for marketing purposes. To be added to our internal Do Not Call list, contact us at (704) 810-2079 or support@insuredirectonline.com.
Opt-Out: Reply STOP to any text message to opt out of SMS marketing. You may also call or email us to opt out of any form of marketing communication.
10. Prohibited Uses
You agree not to use our Services to:
- Violate any applicable federal, state, or local law or regulation
- Submit false, misleading, or fraudulent information in any quote or application
- Impersonate any person, entity, or insurance agent
- Commit insurance fraud or facilitate insurance fraud by others
- Transmit viruses, malware, spyware, or other harmful code
- Attempt to gain unauthorized access to our systems, databases, or other users' accounts
- Scrape, harvest, or collect information from our website without written permission
- Use automated tools (bots, crawlers) without our express written authorization
- Reverse engineer, decompile, or extract source code from our software
- Interfere with or disrupt the availability of our Services
- Upload or transmit content that is unlawful, defamatory, obscene, or invasive of another's privacy
- Use our Services for any purpose unrelated to legitimate personal or commercial insurance needs
Violation of these prohibitions may result in immediate termination of your access to our Services, referral to law enforcement, and/or legal action.
11. Intellectual Property
All content, features, designs, logos, trademarks, text, graphics, software, and materials on our website are owned by or licensed to InsureDirect LLC and are protected by U.S. copyright, trademark, and other intellectual property laws. The AssureArc name, logo, and brand marks are trademarks of InsureDirect LLC.
Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our website for personal, non-commercial purposes. This license does not include the right to: reproduce, distribute, or publicly display our content; create derivative works; use our trademarks without permission; or commercially exploit any content from our Services.
DMCA Notice: If you believe your copyrighted work has been infringed on our website, please send a notice to legal@insuredirectonline.com with: identification of the copyrighted work; description and location of the infringing material; your contact information; a statement of good faith belief; and your signature.
12. Third-Party Services & Carrier Relationships
Our Services involve integration with third-party insurance carriers, rating platforms, payment processors, and other service providers. Links to third-party websites (including carrier sites) do not constitute endorsement of those sites. We have no control over third-party sites and are not responsible for their content, privacy practices, or accuracy.
Carrier Independence: Insurance carriers are independent entities. AssureArc is not liable for carrier decisions regarding underwriting, claims handling, policy terms, premium changes, or any carrier action or inaction after a policy is issued.
13. Disclaimer of Warranties
Our services are provided "as is" and "as available" without warranties of any kind, express or implied.
To the fullest extent permitted by applicable law, InsureDirect LLC disclaims all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties that Services will be uninterrupted, error-free, or secure
- Warranties of accuracy, completeness, or currency of any information on our website
- Warranties that any quote will result in available coverage at the quoted price
- Warranties regarding the suitability of any insurance product for your specific needs
Insurance coverage is ultimately provided by insurance carriers under their own policy contracts, and those contracts, not these Terms, govern the terms, exclusions, and claims procedures of your insurance.
14. Limitation of Liability
To the fullest extent permitted by applicable law, InsureDirect LLC, its officers, directors, members, employees, agents, and affiliates shall not be liable for:
- Indirect, incidental, special, exemplary, punitive, or consequential damages
- Loss of profits, revenue, data, business, or goodwill
- Errors, omissions, or inaccuracies in any quote, content, or information
- Denial of insurance coverage or claims by any insurance carrier
- Differences between quoted and actual premium amounts
- Interruption, suspension, or termination of Services
- Unauthorized access to your account or personal data
- Actions or omissions of any insurance carrier after policy issuance
- Loss or damage arising from your reliance on informational content on our website
Aggregate Liability Cap: In no event shall InsureDirect LLC's total aggregate liability to you exceed the lesser of: (a) the total commissions received by InsureDirect LLC from the specific insurance policy giving rise to the claim, or (b) five hundred dollars ($500.00).
Some jurisdictions do not allow certain liability limitations. To the extent those laws apply, some of the above limitations may not apply to you.
15. Indemnification
You agree to indemnify, defend, and hold harmless InsureDirect LLC and its officers, directors, members, employees, agents, and successors from and against all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of our Services; (b) your violation of these Terms; (c) your provision of false, inaccurate, or misleading information; (d) your violation of any third-party rights; or (e) any insurance fraud you commit or attempt to commit through our Services.
16. Binding Arbitration Agreement
IMPORTANT — PLEASE READ CAREFULLY
This section requires you to resolve most disputes through binding individual arbitration rather than in court. You have the right to opt out within 30 days of first agreeing to these Terms (see Section 16e below).
16a. Scope of Arbitration
Except as provided below, you and InsureDirect LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, our Services, your use of our website, or any insurance-related services provided by InsureDirect LLC shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in a court of law.
16b. Exceptions
The following are not subject to this arbitration agreement:
- Small claims court actions (within that court's jurisdiction)
- Applications for temporary restraining orders or emergency injunctive relief
- Claims relating to InsureDirect LLC's intellectual property rights
- Complaints filed with state insurance regulators or departments (always available to you)
- Complaints filed with the NC Department of Insurance
16c. Arbitration Process
Arbitration shall be conducted by a single neutral arbitrator. The place of arbitration shall be Mecklenburg County, North Carolina, or by videoconference upon request. The arbitrator shall have authority to award any remedy available at law or in equity to an individual. The arbitrator's decision is final and binding and may be entered as a judgment in any court of competent jurisdiction.
16d. Costs
AAA filing fees are governed by the AAA Consumer Arbitration Rules. InsureDirect LLC will pay all filing, administration, and arbitrator fees for any claim under $10,000, unless the arbitrator finds your claim to be frivolous. Each party bears its own attorneys' fees unless applicable law provides otherwise.
16e. Opt-Out Right
You may opt out of this arbitration agreement by sending written notice to InsureDirect LLC at legal@insuredirectonline.com or the address below within 30 days of first agreeing to these Terms. Your notice must include your name, email address, phone number, and a clear statement that you wish to opt out of arbitration. Opting out does not affect any other terms.
17. Class Action & Jury Trial Waiver
YOU AND INSUREDIRECT LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR MASS ARBITRATION PROCEEDING.
Unless mutually agreed in writing, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
Jury Trial Waiver: To the extent any claim proceeds in court rather than arbitration, YOU AND INSUREDIRECT LLC WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO SUE IN COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY.
18. Governing Law & Jurisdiction
These Terms and any dispute arising out of or relating to them shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict-of-law principles.
For any claims not subject to the arbitration provision in Section 16, you and InsureDirect LLC agree to submit to the exclusive personal jurisdiction of the state and federal courts located in Mecklenburg County, North Carolina, and waive any objection to venue or jurisdiction in those courts.
State Insurance Laws: Nothing in these Terms limits any rights you have under applicable state insurance laws, including the right to file complaints with the North Carolina Department of Insurance or the insurance department of your state of residence.
19. Force Majeure
InsureDirect LLC shall not be liable for delays, interruptions, or failures in performance of our Services resulting from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemic or public health emergency, war, terrorism, civil unrest, power outages, internet or telecommunications disruptions, cyberattacks, government action, or actions of insurance carriers or other third parties. We will make commercially reasonable efforts to resume normal operations as promptly as practicable.
20. Termination & Suspension
InsureDirect LLC reserves the right to suspend or terminate your access to our Services, with or without notice, for any reason including but not limited to: violation of these Terms; fraudulent activity; providing false information; or conduct that disrupts our Services or harms other users.
Termination of your access does not affect any insurance policies already in force with a carrier, or any rights or obligations that arose prior to termination. Sections 6, 10–17 survive termination of these Terms.
21. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date at the top of this page and, where appropriate, by email or website notice. We encourage you to review these Terms periodically.
Your continued use of our Services after the effective date of any modification constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using our Services.
22. Miscellaneous Provisions
Severability
If any provision of these Terms is found by an arbitrator or court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.
Entire Agreement
These Terms, together with our Privacy Policy, any applicable service agreements, and any written disclosures provided at the time of service, constitute the entire agreement between you and InsureDirect LLC regarding use of our Services and supersede all prior agreements, communications, and understandings.
No Waiver
InsureDirect LLC's failure to enforce any provision of these Terms shall not constitute a waiver of that provision or our right to enforce it in the future.
Assignment
You may not assign your rights or obligations under these Terms without our prior written consent. InsureDirect LLC may assign these Terms in connection with a merger, acquisition, or sale of substantially all of our assets.
23. NC DOI — Regulatory Oversight & Complaints
InsureDirect LLC is licensed and regulated by the North Carolina Department of Insurance. Nothing in these Terms limits your right to file a complaint with your state's insurance regulator.
